Affiliate Program Terms

These terms describe the proposed rules for approved participants in the Smoke Checked Affiliate Program.

DRAFT FOR LEGAL REVIEW — NOT YET EFFECTIVE.
This draft is published so applicants can review the proposed program. It requires legal approval before affiliate codes, attribution, commissions, or payouts are activated.

1. Eligibility and Application

Applicants must be at least 18 years old, provide complete and accurate information, and be legally able to participate. Smoke Checked may approve, decline, waitlist, or request more information from any applicant. Submission does not guarantee acceptance.

2. Approval and Account Status

An affiliate relationship begins only after written approval and activation by Smoke Checked. Applicants may not create, announce, or use an affiliate code before activation. Smoke Checked may review an affiliate's content and compliance throughout participation.

3. Codes, Links, and Customer Discount

Approved affiliates may receive a unique code or referral link. The proposed customer benefit is 10% off eligible merchandise. Codes are nontransferable, may not be sold, and may not be altered or posted to unauthorized coupon or deal sites. Discount stacking is unavailable unless Smoke Checked approves it in writing.

4. Qualifying Commission

The proposed commission is 10% of the discounted eligible merchandise subtotal on a qualifying purchase. Shipping, sales tax, gift cards, refunds, returns, cancellations, chargebacks, fraudulent transactions, free or replacement products, and ineligible items do not earn commission. Smoke Checked's transaction records control unless an affiliate identifies a documented error.

5. Attribution and Validation

A qualifying transaction must be properly attributed to the affiliate's activated code or link. The proposed validation period is 30 days after purchase. A transaction remains pending during validation and becomes approved only if payment is settled and no disqualifying event occurs. Returns, disputes, or other reversals may reduce or reverse commission.

6. Payouts

The proposed payout threshold is $50 in approved commissions, with eligible payments scheduled monthly after validation. Payout timing is not guaranteed and depends on completed recipient onboarding, tax or identity requirements, fraud review, and payout availability. Proposed payouts use Stripe Global Payouts; availability and recipient eligibility must be verified before activation. Affiliates must never send banking, tax, or identity documents through the public application form or ordinary email.

7. Required Disclosures

Affiliates must clearly and conspicuously disclose the compensated relationship close to every endorsement, link, or code. The disclosure must be easy to notice and understand. Examples include “I may earn a commission if you purchase using my link or code” and “Paid affiliate link.” Platform tools alone may not be sufficient.

8. Promotion Standards

Affiliates must be truthful, respectful, and consistent with the Affiliate Brand Guidelines. Affiliates may use only authorized claims and assets and may not imply that they are a Smoke Checked employee, agent, legal representative, or official spokesperson.

9. Prohibited Conduct

  • Self-referrals, collusive transactions, false orders, artificial traffic, cookie stuffing, tracking manipulation, or other fraud.
  • Unapproved brand-keyword bidding, paid search ads, domain names, usernames, or social handles that impersonate Smoke Checked.
  • Spam, unlawful email or SMS promotions, misleading claims, harassment, hate, or illegal content.
  • Posting codes to unauthorized coupon sites, browser extensions, or automated discount tools.
  • Copying, modifying, reselling, sublicensing, or using brand assets outside approved promotions.

10. Intellectual Property

While an affiliate remains approved, Smoke Checked grants a limited, revocable, nonexclusive, nontransferable license to use specifically approved brand assets solely to promote eligible Smoke Checked products under these terms. All ownership remains with Smoke Checked and its licensors.

11. Independent Relationship

Affiliates are independent participants, not employees, partners, franchisees, agents, or representatives. Affiliates have no authority to bind Smoke Checked, negotiate on its behalf, make warranties, or incur obligations for it. Affiliates are responsible for their own taxes, licenses, expenses, equipment, and legal compliance.

12. Suspension and Termination

Smoke Checked may suspend or terminate participation, disable a code, hold pending amounts, or investigate activity when it reasonably suspects fraud, policy violations, reputational harm, legal risk, or technical misuse. Valid approved balances will be handled under the final legally approved terms and applicable law.

13. Privacy and Security

Application and program data is handled according to the Privacy Policy. Affiliates must keep account access secure and promptly report suspected compromise to affiliates@smokechecked.com.

14. Program Changes

Smoke Checked may modify or discontinue the program, its rates, eligibility, products, validation period, or payout procedures. Material changes will be communicated before they apply whenever reasonably practicable. Continuing after an effective update constitutes acceptance of the updated final terms.

15. Governing Law — Draft

This proposed program will be governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-laws rules, together with applicable federal law. This clause remains subject to legal review.
